Affirmative Action in the Supreme Court
When there is a vacancy on the Supreme Court of the United States (SCOTUS) both Congress and the President begin an agenda of filling the vacancy. According to the Constitution, it is the President with both the authority and responsibility to nominate a Supreme Court justice and the Senate is to confirm the nomination while the Chief Justice administers the Oath of Office.
When Justices Gorsuch, Kavanaugh and Barrett were nominated their confirmation hearings were broadcast publically so that everyone became politically divided. Instead of questioning each potential justice on where they stood constitutionally, they were caught up in tabloid-style allegations and treated unbecoming as one potentially becoming a Supreme Court justice.
The recent announced retirement of Justice Breyer has once again heated up the debate as President Biden is said to be considering a woman of color for the bench, which mocks the sanctity of the Court, is unlawful and entirely unbecoming to use gender, skin color or political affiliation for consideration rather than judicial experience, track record or standing on the constitutionality of cases to be brought before this esteemed body.
Do you remember hearing then Senator Kamala Harris calling Judge Amy Coney Barrett a liar during her confirmation hearing in 2020? That conduct from a member of Congress is totally unnecessary and absolutely uncalled for. – I am the Real Truckmaster!
America has not always had an Immigration Problem. The facts are that the immigration policy as it is in 2018 has major issues that can only be resolved by the United States Congress. In my opinion the Congress should remain in session while working diligently on a Comprehensive Immigration Reform solution to the issue of illegal immigration.
The United States continues to have the most open immigration policy in the world. It wasn’t until after the Civil War that certain states began passing immigration laws, and in 1875 the Supreme Court declared the regulation of immigration a federal responsibility. In 1891 the Immigration Service was established.
The period from 1900 to 1920 was known as the “Great Wave” where nearly 24M immigrants arrived in the U.S. After WWI congress addressed the increasing immigration flow with a new immigration policy, in the form of “The National-Origins Quota System” passed in 1921 and revised in 1924. Immigration was limited by nationality quotas based upon past U.S. census figures. In 1924 Congress created the U.S. Border Patrol within the Immigration Service.
Over the next 20 years there was very little immigration and actually dropped below zero during the Depression, and during and following WWII, because the 1920s national-origins system remained in place after being re-codified by Congress and combining all immigration laws into the Immigration and Nationality Act of 1952. American agriculture continued to import seasonal labor from Mexico and the 1951 Bracero Program became a permanent agreement between the U.S. and Mexico.
In 1965 Congress replaced the national origins system with a preference system designed to unite immigrant families and attract skilled immigrants, changing national policy in effect since 1924. It seems that a majority of applicants for immigration visas was now coming from Asia and Latin America, rather than Europe. The preference system continued limiting the number of available immigration visas, but Congress still responded to refugees with special legislation. It was not until the Refugee Act of 1980 that the U.S. had a general policy governing the admission of refugees.
In 1986 Congress passed the Immigration Reform and Control Act (IRCA) with two major facets: Amnesty and Enforcement. The IRCA amnesty required aliens to have completed one of two provisions: continually reside in the U.S. since January 1982 OR completed 90 days of agricultural work between May 1985 and May 1986. Due to the estimated fraud involved in this program, there was offered a Late Amnesty which allowed those fighting denial to reapply. The IRCA contained provisions for enforcement to prevent illegal entry. The provisions prohibited the hiring and harboring of illegal aliens, but few resources were allocated for enforcement.
The 1990 Immigration Act modified and expanded the 1965 act while retaining family reunification as the major entry path and provides for the admission of immigrants from “under-represented” countries by a lottery system and mandated a study of immigration known as the “Jordan Commission”.
The U.S. Commission on Immigration Reform (Jordan Commission) ran from 1990 to 1997 and covered the many facets of the immigration policy, from the perception that the immigration policy “credibility yardstick: people who should get in, do get in; people who should not get in, are kept out; and people who are judged deportable are required to leave.”
The commission issued a series of four reports: The first report cited that enforcement was lax and needed improvement on the border and internally with an “automated employment verification system” for employers to distinguish between legal and illegal workers. The second report suggested immediate family members and skilled workers receive priority. The third report covered refugee and asylum issues. The fourth report reiterated the major points of the previous reports and the need for a new immigration policy. Few of these suggestions were implemented.
In 1996 Congress passed the Illegal Immigrant Reform and Immigrant Responsibility Act (IIRIRA). The act mandated hiring more border patrol and INS agents. Penalties for illegal entry were increased and a border fence was planned for San Diego, while an automated employment verification pilot program was created and state police officers were allowed to enforce immigration law using the 287(g) program. Poor funding again hindered enforcement.
During the 1990s four smaller amnesties were passed. The first was section 245(i) amnesty, passed in 1994 which pardoned around 578,000 illegal aliens who were each fined $1,000. This amnesty was renewed in 1997 and again in 2000. The second was the Nicaraguan Adjustment and Central American Relief Act (NACARA) was passed in 1997 giving legal status to about 1M illegal aliens, mostly from Central America who had lived in the U.S. since 1995. In 1998 the Haitian Refugee Immigration and Fairness Act (HRIFA) passed to include Haitians. In 2000 the Legal Immigration Family Equity Act (LIFE) a mini-amnesty aimed at those illegal aliens who hoped to become green card holders through marriage, employment and other categories who still had a long line of people ahead of them. From 1994 to 2000 there were millions of hopeful legal immigrants waiting in line overseas.
After the terrorist attack on September 11, 2001 perspectives on many issues changed including immigration. The attack exposed long-standing holes in our immigration system, including visa processing, internal enforcement and information sharing.
In 2006 immigration reform was again discussed in Congress with both houses producing their own conflicting bills. In December 2005 the House passed the Border Protection, Anti-terrorism, and Illegal Immigration Control Act of 2005 and was limited to enforcement on both the border and the interior. In May 2006 the Senate passed the Comprehensive Immigration Reform Act of 2006 (CIRA) that would have given amnesty to a majority of illegal aliens already in the country as well as dramatically increased legal immigration. No compromise bill resulted.
In 2007 the Senate attempted to pass amnesty legislation in the form of the Comprehensive Immigration Reform Act of 2007, which would have given amnesty to a large majority of illegal entrants in the country and significantly increased legal immigration and increased enforcement. Although the act had bipartisan support in the Senate it lacked public support and failed to obtain a passing closure vote.
In 2012 President Obama became tired of waiting on Congress and unconstitutionally used the power of Executive Order to create the Delayed Action on Childhood Arrivals (DACA) to allow a path to citizenship for certain illegal immigrants who are residing within the U.S. Congress neither condemned this action by the president, nor did they then attempt to fix the problems with the immigration system.
In 2018 President Trump decided to secure the U.S. southern border by building a physical barrier wall and enforce immigration laws to prevent unlawful entry and conduct deportation hearings to remove illegal immigrants.
At that time what was not being questioned was the fact that Mexico and her southern neighbors have not addressed or offered (as required by international law) asylum or refugee status to those who have been given a “pass” and facilitated to the U.S. – Mexico border.
The Department of Homeland Security, the Immigration and Naturalization Service and the U.S. Border Patrol are charged with enforcement of existing laws.
What played out in the media were vocal opposition to immigration enforcement by the very politicians with the power to correct through immigration reform the situation along our southern border.
This process became complicated when “legal experts” crossed over into Mexico to coach migrants on how to give “amnesty seeker” responses before immigration judges at the border. Those individuals face disbarment and criminal action for facilitating the circumventing of U.S. immigration laws.
The big cry became “separation of families” at the border which would only happen with unlawful entry – just make the right choice.
What happened to the introduction the “Emergency Legislation” proposed by Senator Ted Cruz that casts a glimmer of hope for immigrant families. – Double the number of Federal Immigration Judges from 375 to 750; Authorize new temporary shelters, with accommodations to keep families together; Mandate illegal immigrant families “Must Be Kept Together”, absent aggravated criminal conduct or harm to the children; & Provide for expedited processing and review of asylum cases, so that – within 14 days – those who meet the legal standards will be granted asylum, and those who do not will be immediately returned to their home countries?
In 2021 the migration “game” changed considerably when President Biden opened the southern border by allowing thousands of illegal migrants without documentation or without inoculations against the current virus pandemic or other infectious diseases to be given transportation, funds and housing in various cities across the nation in direct violation of U.S. Immigration laws, while continuing to enforce those laws at international airports and other ports of entry.
What is even more outrageous is the fact that on day one President Biden stopped the construction on the southern border wall, even though the material needed has already been paid for and crews had been stopped from conducting a work in progress. Even today there has been no outpouring of outrage from Congress or the public and no effort to stem the illegal flow of migrants who in many cases are being passed off as “refugees”.
What happens when the President of the United States, the Vice President of the United States and the United States Congress become federal law breakers instead of following the legislative process to change otherwise outdated or ineffective laws that just don’t work? Do we cast them into the dungeons for eternity or hold them fully accountable for their actions?
No we should expel them from elected office, charge them with violating immigration laws and bar them from ever holding elected office again! – I am the Real Truckmaster!
Have you noticed how our young people see themselves as different, yet when in a crowd nobody stands out? What happened to dressing for success? Neatly groomed men and women in the workforce have become a thing of the past. And then there is the “if you can see it, you can be it” mantra that equates to do what makes you feel good. That may be well and good, but when you look outside yourself what do you see? We are conditioned to group people into two camps – Us and Them. Reality does not really matter, only perceived reality becomes reality when it is repeated over and over again and again. We identify with what makes us feel good. Too many times someone sees you and wants to be you, to the point that when given the opportunity they destroy you. Instead of looking for things that bind us together we become distracted by our differences, to the point that our vision is skewed and totally out of kilter.
When immigrants come to this country they know that hard work, determination and perseverance will lead them to citizenship where they will become Americans. Starting out they take any job they can get regardless of education or socioeconomic class. They may begin cleaning toilets until one day their hard work ethics enable them to own the business. To the outsider looking in through jealous eyes they see immigrants owning certain types of businesses and make assumptions that all XXXX’s own convenience stores, or drive certain vehicles, or live in certain neighborhoods. Over time that thought process morphs into my people are victims and your people took advantage of us and now you owe us retributions and I want what is owed me. PAY UP!
Where in biblical theology does it say you are your brother’s accuser?
Are we not our brother’s keeper? Is it not our responsibility, our obligation to look after our neighbors and to help out when needed or asked because it’s the right thing to do? Or do we simply turn our backs and look the other way? If you see a child playing in the middle of a busy street are you going to say or do nothing? What if it was your child would you want everyone else to say or do nothing as well?
Let me be clear just as surely as I’m writing these words we are all in a race – the human race. We are all competing for the prize that comes at the end of our race. Will we each get what we deserve or mercy? It behooves us to be like the runner and stay in our lane. Stop trying to live anybody else’s life, but live our own as God intended.

If you’re going to be one – be kind, be generous and love your enemies for in doing so you will show the will of God which mankind so earnestly needs. Treat others with the respect that you deserve! – I am the Real Truckmaster!
While watching the movie Gandhi yesterday I was struck with history repeating itself over and over again. I loved the scenery and the sets, but my mind kept wandering back to the American Revolution where our people faced the exact same thing as British “overseers” living lavish lifestyles at the expense of hard working folks in the colonies as destitute “subjects” merely trying to survive. As in America, Indian subjects were unjustly subjected to a similar fate until it took one man to stand up to the British Crown. It must have occurred to Gandhi (a learned attorney) that what happened in America must happen in India as well.
I began thinking of some of the dialog “there are tyrants and dictators, but truth and love always win” (loosely paraphrased). Globally mankind is being subjected to unjust laws or “mandates” meant not to protect against a virus, but using fear to control the masses in what can best be described as organized and government controlled mob rule.
The bible tells us that Jesus is the Truth and God is love, therefore we know who has ultimately won already. Unlike in the movie or in real life where Gandhi says we must find our own road to heaven by doing good; Jesus said “I am the way, the truth and the life. No man comes to the father but through me.”
Doing good works doesn’t get you past the pearly gates, yet we are expected to live at peace with one another when it’s within our power to do so. In the movie we see that India gained her independence from British rule only to become divided by religion and it was 74 years ago today that Mohandas Gandhi was shot and killed as a direct result of that division. Today India and Pakistan continue to be arch enemies as the world simply watches.
People who do not learn from history are doomed to repeat it. America’s greatest danger comes not from outside, but from within by those who threaten to domestically undermine the US Constitution, out government and the American way of life. What will it take for you to stand up! – I am the Real Truckmaster!
My final overseas tour was to US Army Japan beginning in January 1989. I was told not to worry about field duty but to get enrolled in college courses to finish my degree. Two weeks into my tour and my first college class I received a phone call to come over to Camp Zama to be issued my field gear for a 30 day Corps level exercise called North Wind 89. I soon found myself on a plane flying from Hanada airport to the northern island of Hokkaido. As we travelled across the snowy countryside headed for a Japanese Self Defense Army installation for a moment I felt like I was back in Colorado.
My job was that of a dispatcher/shuttle driver responsible for taking troops from and to the airport or training areas, as directed. My available vehicles were an Isuzu van or a Mitsubishi 4-wheel drive vehicle. One of my first dispatches was to pick up an SF A-team and transport them to the rifle range over an unpaved surface resembling a tank trail back in Colorado.
As we were bouncing along the snow covered single lane road you could hear the guys talking and joking back and forth as the captain casually asked “sergeant how long have you been in Japan”? It was a seemingly innocent question clearly meant to pass time and relieve the boredom of the ride.
My answer wasn’t at all what he expected as I replied, “Two weeks sir”.
Everything went quiet, no joking, talking or breathing for that matter. All one could hear was the springs creaking as we hit bump after bump. Finally he ventured another question, “Where were you before Japan?” Without missing a beat I replied, “Fort Carson”. There seemed to be this huge sigh of relief as everyone continued their conversations again as if nothing had happened. I can still remember walking through the snow from the Base Exchange back to the barracks eating an ice cream bar and wishing I was still in Colorado. On the way out Green Beret Sergeant Kengo Duffy gave me the keepsake (pictured above). True story – The Real Truckmaster!
There’s a reason for not putting all of your eggs in one basket and it may be lost on anyone who hasn’t been on or around a farm. We’ve been told by politicians in recent memory that do as I say or you’re public enemy number one.

Stay home = keeps us safe
Give up your guns = keeps us safe
Vote democrat = keeps us safe
Don’t spread misinformation = keeps us safe
All gas powered vehicles must become eVehicles = to keep us safe
Opening the nation’s border = keeps us safe
Parents don’t challenge school curriculum = public enemy, domestic terrorists
Support MAGA = public enemy, domestic terrorists, white supremacy, hate group
NRA = sponsors domestic terrorism
GOP = un-American, bad for our nation
Patriotism = fosters white supremacy
The list could go on indefinitely and all it does is foster hatred, division and disunity.
Hillary called it “a basket of deplorables” while JB used “lying pony soldiers” and worse to show their superiority over average Americans.
Trump called it “Making America Great Again” and was continually roasted over the coals for his insightful hate speeches.
Americans have hoisted 546 eggs into one huge swamp basket to represent the federal government, add to that presidential appointments, other elected officials at federal, state and local governments and what he have now is a colossal failure to communicate. As heat is applied those eggs scream their superiority at the top of their lungs and emit a stench unlike any the world has every smelt!
It’s time to get real!
We have all been created equal. Nobody is above the law or exempt from the consequences of their action. We must hold ourselves and each other accountable. If not, who will?
There is a saying “if you can see it, you can be it”, so apply that to the stench of unethical, un-American and un-civilized treatment which we freely apply to our fellow man and nobody comes out smelling like a rose. Advertisers want us to get “all we deserve” and without the grace of Almighty God we will very well get exactly what we deserve. We have but one life to live. Nobody and I mean nobody is getting out alive! – I am the Real Truckmaster!
If the art of deception defines politics, then the artists should be called politicians. We are being told that our nation is democratic and as such everyone deserves to be treated equally with free healthcare, free housing, free food, free higher education, better job opportunities, higher wages and industry controlled or regulated by the government who tell us that democracy is a good thing where everybody has a voice and society is aimed at the good of all. It all sounds so very appealing. To object is to become the enemy of society.

Of the 206 nations listed in the UN System, there is only one that is a deliberately different form of republic, a Constitutional-Republic, meaning the Constitution is the law of the land. The United States of America is that nation, recognizing that men are created equal by God, as such is endowed with certain unalienable rights that did not come from a government that has been given limited power by the people with checks and balances to prevent an authoritarian ruler having a desire or quest for absolute power.
We have been spoon fed a diet of misinformation, aided by social media fact checkers, main stream media spokespersons, advertising gurus as well as elected and appointed government officials. We are told that patriotism is terrorism, parents are domestic terrorists, and radical socialism is patriotism.
In the late 1930s thistechnique was developed to undermine a person’s perception of reality and it was called gaslighting.
Our nation has been divided by social, economic, religious, racial and ethnic classes in order to prevent the people from uniting as one and overthrowing tyrannical overlords as we did some 240+ years ago.
We must never forget that we are One Nation Under God, With Liberty and Justice For All. Have we not learned from our past or from the history we so bravely fought and died for – to keep all men free?
We either become the solution or we continue to be the problem! – I am the Real Truckmaster!
The Peter Principle is a concept in management theory formulated by educator Laurence J. Peter and published in 1969 that states “that the selection of a candidate for a position is based on the candidate’s performance in their current role, rather than on abilities relevant to the intended role. Thus, employees only stop being promoted once they can no longer perform effectively, and “managers rise to the level of their incompetence””.
It is obvious that going far beyond the Peter Principle is the Biden Principle where tearing American customs, ingenuity, traditions and actual history are the first steps toward building back better. One must tear down and destroy before advancing back to a new normal where citizenship is good only for paying taxes and voting (providing you vote Democrat).
American’s have always taken an idea and found ways to make it better, easier or more efficient. So why tear it all down to start over unless this new normal is not based or relies on the US Constitution?
It appears that while the Executive, Legislative and Judicial Branches of Government or officials at federal, state and local levels act as if they are above the law and cannot be touched.

In early 2020 I wrote an article reporting on an OAN investigative report concerning substantiated facts concerning what was then called the 2019-nCoVd virus. We’re way beyond that now and over the course of 2 years we have experienced the global panic of the initial virus, followed by an unending series of “variants” keep the world population fearful of “what if”……..
The initial investigative report examined the initial timeline of events leading up to the release of the virus on the world stage by Chinese operatives in Wuhan, China. Almost immediately the Chinese countered with finger pointing to US military sports participants at a Chinese hosted series of events in 2019. Then it was the open meat market in Wuhan that was the culprit. Failing to convince everyone, there was the race-baiting anti-Chinese marketing meant to quench anything directed at the real culprit?
Without rehashing my original article “Assessing the Chinese Wuhan Virus” let me continue with what has transpired over the past 2 years.
In America we were told to self-isolate for 14 days to stop the spread and then we were told to mask up so we don’t spread our germs to others.
Then came the mandates, stay home no socializing, mask up and no religious services or “non-essential” business dealings, and finally get jabbed or lose your jobs, licenses and freedom of movement without documentation of up-to-date vaccinations and boosters.
International travel was all but banned globally as other countries followed suit.
To make matters worse, first responders, hospital workers, police and even the military have been mandated to vaccinate or be terminated.
There seems to be no end to this madness, unless Americans take charge politically and removed deranged politicians at the ballot box in every upcoming election (federal, state or local).
These measures have all but completely overshadowed the influx of illegal and undocumented and largely unvetted or unvaccinated migrants who have been ALLOWED to cross through the US-MEXICO border from Texas to California with IMMUNITY. They are being called refugees, which they are not. Every elected/appointed official (federal, state or local) who has aided assisted or enabled illegal migrants to cross into US territory are themselves LAW BREAKERS and they must be held accountable (politically and legally) for their actions.
The US economy has been and is being affected by the mandate to convert all government vehicles to electric vehicles over the next 10 years, while pipelines in Alaska that brought in fossil fuels have been sealed shut making the US totally dependent on foreign oil.
What has not been discussed or thought out is how the electrical infrastructure and power grids are supposed to handle the massive influx of electric vehicle charging stations without the use of fossil fuels.
I said it would get interesting and it has. Americans have been gullible to the gaslighting of America over the past few years. It’s time to make things right. Our children and grandchildren deserve it! – I am the Real Truckmaster!
I grew up with the saying “don’t beat around the bush”. Context has everything to do with it.
If you are rounding up poultry or trying to drive out reptiles on a farm they sometimes hid under bushes, shrubs, behind firewood or wherever they feel it safe. One way to get them out is to circle around while beating the bush causing lots of noise. This frightens them and they run or slither away because they’re scared.
People often act the same way.
When frightened or scared the fight or flight response kicks in and people will either come out swinging, lashing out verbally or both before running wildly in any direction.
Politicians know that divide and conquer while egging people on is an easy way to manipulate massive numbers of frightened people with fear of the unknown.
During close quarter, hand-to-hand combat a small force will often link arms or stand back-to-back over a superior force when they are outnumbered thus forming a human shield.
When preparing to deliver bad news or to avoid outright confrontation it is often acceptable to beat around the bush rather than coming right out and saying something unpleasant.
I’m reminded of this fictional story of a drill sergeant being told that Private Smith’s mother had just died. It was up to the drill sergeant to break the news to the recruit. So the drill sergeant goes outside where everyone is in formation and asks for a show of hands of how many have mothers back home? Almost all hands go up. The drill sergeant yells out “Not you Private Smith, but your hand down.”
Now that really didn’t happen but it was a sort of beating around the bush moment, wouldn’t you agree? – I am the Real Truckmaster!
