Anchor Babies and the 14th Amendment

 

President Trump has indicated that he’s going to issue an executive order putting a stop to the Anchor Baby citizenship debacle.

 

I know what you’re going to day. Everyone born on US soil is automatically an American citizen, right? Not so fast Sherlock that may not be true. In fact that may be the complete opposite of what is written in Section 1 of the 14th Amendment.

 

Amendment XIV (1868)

Section 1. “All persons born or naturalized in the United States and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside……….”

 

When the amendment was written the writer specifically noted that no special law was being made, but it was to include blacks who had been slaves and thus not afforded the rights and privileges of citizenship.

 

Although the 14th Amendment has been challenged in the SCOTUS a number of times and upheld, there still seems to be an overall misunderstanding over its intent and meaning. A child is born to a natural born or a naturalized US citizen parent they are in fact citizens by birth.

 

 

In fact the misunderstanding is over what it didn’t say.

 

The 14th Amendment did not give automatic citizenship to foreign visitors, foreign dignitaries or illegal aliens nor did it give citizenship to offspring of foreigners born while on US soil, they are simply called uninvited guests who have unlawfully entered the US and are not US citizens by birth. They are citizens of the country of their mother’s citizenship.

 

Forget all the misinformation coming out of the main stream media or even when it is communicated by members of the US Legislature or other political figures. All foreigners must apply for citizenship and complete the naturalization process to be sworn in as US citizens after taking the oath of allegiance to this country and our flag. This includes denouncing their allegiance to their former homeland and forfeiting their citizenship.

 

DACA recipients were allowed to reside in the US with a path to citizenship that was illegal and unconstitutionally done through executive order of Barack Obama. Steps to terminate or invalidate it have been met with stiff resistance from politicians and through the legal system.

 

Although not needed, an executive order to close the door to what has become a lucrative business of encouraging and taking advantage of Anchor Babies is the perfect way to change the “business as usual” thinking of those engaged in the process. Any executive order issued by President Trump should probably include a directive invalidating or revoking the citizenship of EVERY Anchor Baby to date.

 

At the same time Congress should seriously consider Comprehensive Immigration Reform that closes loopholes and clears up confusing language leaving no doubt new immigration standards for the United States. The president may also want to close the borders to immigrants wanting to cross into the US from Mexico until such time as he feels that immigration control has become satisfactory. – I am the Real Truckmaster!
